BOOKING POLICY

A legal disclaimer

1. Payments:

Initial Payment: A 50% upfront payment is required before the commencement of any project. This payment secures the booking and initiates the work.
Final Payment: The remaining 50% is due upon project completion or as per agreed milestones. The final payment must be made before any final deliverables are released.

2. Non-Refundable Retainers:

Booking Retainer: A non-refundable retainer of 50% of the total project cost is required at the time of booking. This amount is included in the initial payment and secures the client’s spot on the project calendar.
Service Retainer: For ongoing services such as digital marketing, a monthly non-refundable retainer equivalent to 50% of the total monthly fee is required to maintain continuous service.

3. Cancellation Terms:

Client-Initiated Cancellations:
- Within 7 Days of Project Start: Clients may cancel with a 50% refund of the total project fee, minus the non-refundable retainer.
- After 7 Days: Cancellations will result in forfeiture of all payments made, including the non-refundable retainer. The client may be responsible for additional fees based on work completed up to the point of cancellation.
Agency-Initiated Cancellations:
- Oasis House Agency reserves the right to cancel a project at any time due to unforeseen circumstances or breach of contract by the client. In such cases, the client will be refunded all payments made, excluding the non-refundable retainer, unless work has already been delivered.

4. Project Milestone Delivery:

Milestone Agreements: Projects will be broken down into specific milestones, each with its own set of deliverables and corresponding payment schedules.
Client Responsibilities: Timely feedback and approvals are required from the client to maintain the project schedule. Delays in client responses may extend the delivery timeline.
Revisions: Two rounds of revisions are included per milestone. Additional revisions may be subject to extra fees.

5. Revisions and Additional Work:

Included Revisions: Two rounds of revisions are included within each project phase. Additional revisions will be billed at an hourly rate of $150.
Scope Creep: Any requests that fall outside the agreed scope of work will require a change order and may incur additional charges.

6. Intellectual Property Rights:

Ownership Transfer: All designs, marketing materials, and intellectual property created by Oasis House Agency remain the property of the agency until full payment is received. Upon final payment, ownership rights are transferred to the client.
Portfolio Use: Oasis House Agency reserves the right to use completed projects in their portfolio and marketing materials, unless otherwise agreed upon in writing.

7. Confidentiality and Non-Disclosure:

Confidential Information: Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the project. This includes but is not limited to business strategies, financial information, and personal data.
Non-Disclosure Agreement (NDA): An NDA can be signed upon request to further protect the confidentiality of the client’s information.

8. Dispute Resolution:

Mediation: In the event of a dispute, both parties agree to first attempt to resolve the issue through mediation.
Governing Law: These terms and conditions are governed by the laws of the state where Oasis House Agency LLC is registered in the State of Oregon.

9. Force Majeure:

Oasis House Agency is not liable for any delays or failures in performance resulting from events beyond its reasonable control, including but not limited to natural disasters, acts of war, or government actions.

10. Amendments:

Terms Updates: Oasis House Agency reserves the right to update these terms and conditions at any time. Clients will be notified of any significant changes.
